Maryland is home to a diverse range of colleges and universities, including the University of Maryland, University of Baltimore, the Johns Hopkins University, St. Mary’s College of Maryland and Morgan State University. Maryland is also home to numerous private colleges and universities located throughout the state. Collectively, Maryland’s public and private institutions serve nearly 400,000 students.
With so many students navigating complex academic environments, disputes and conflicts are inevitable. Students may find themselves facing allegations of misconduct, disciplinary proceedings, academic challenges, or other school-related issues that could have serious consequences for their education and future career.
When a school imposes significant sanctions or takes disciplinary action against you, it can be difficult to know where to turn or how to protect yourself. An experienced student defense attorney can help you understand the process, evaluate your options, and advocate for your rights.
You should not have to navigate a complicated disciplinary process alone or allow a Maryland school’s actions to jeopardize your education and professional future. Having knowledgeable legal counsel on your side can help demystify the disciplinary process, ensure that you understand your rights and obligations, and develop a strategy designed to protect your academic and professional interests.
When your education and future are at stake, having the right advocate in your corner can make all the difference.
The University System of Maryland was established in 1988 through the consolidation of the University of Maryland and the Board of Trustees of State Universities and Colleges.
Although the institutions within the University System of Maryland operate independently, they are governed and overseen by the Board and generally maintain similar student codes of conduct and disciplinary procedures.
Maryland is also home to 18 private colleges and universities, including four religiously affiliated institutions. While each school has its own policies, codes of conduct, and disciplinary structures, the procedures for addressing student complaints and allegations of misconduct are often similar. Depending on the institution, different administrators, faculty members, committees, or hearing bodies may be responsible for investigating allegations, making disciplinary decisions, and imposing sanctions.
Understanding how a particular school handles misconduct allegations is critical. Below, we provide an overview of the disciplinary processes at several of Maryland’s larger colleges and universities, including what students can expect when facing allegations of misconduct and the potential consequences that may follow.
The University System of Maryland (USM) has 12 schools under its jurisdiction:
The University of Maryland, College Park is the largest institution within the University System of Maryland. Unlike many schools that use one comprehensive code of conduct, the University maintains separate policies addressing different types of student conduct.
These include the Code of Student Conduct, Code of Academic Integrity, and Policy and Procedures on Sexual Harassment and Other Sexual Misconduct. Each outlines prohibited conduct, applicable procedures, and potential sanctions.
The University of Maryland’s Code of Student Conduct list of prohibited behaviors includes the following:
The Code of Academic Integrity focuses on academic dishonesty, including prohibited conduct as follows:
These policies include Title IX, which is explained further below, and prohibit the following:
Sexual harassment of any kind, including:
Other sexual misconduct, including:
Title IX hearings at Maryland colleges and universities do not follow the Federal Rules of Evidence. This means the school may consider evidence that would not normally be allowed in court, including statements or information based on what someone else said rather than personal knowledge. The University of Maryland loves to rely on this provision when finding respondents guilty and will be the first to remind you that Title IX proceedings “are not a court of law.”
After the hearing, the hearing panel or committee will typically make findings and recommend what, if any, disciplinary action should be taken. A school president or other designated official will then make the final decision. A school president or other designated official then issues the final decision, which may be subject to appeal.
Facing a student misconduct allegation or other school-related issue can be stressful and overwhelming. Whether you are dealing with a plagiarism accusation, academic misconduct, a disciplinary charge, or a serious Title IX matter, having an experienced attorney-advisor on your side can make a significant difference.
A knowledgeable student discipline attorney can help you understand your rights, navigate your school’s disciplinary process, negotiate on your behalf, and, when necessary, advocate for you in litigation. Having experienced legal counsel can help ensure that your voice is heard and that your rights are protected throughout the process.
